Hi

Just saw it thanks, I have already contacted my local MP and she has actually called me this morning to tell me she will be in contact with another MP to sort it out as the other one is the person most relevant to my case


She did however email me twice and called me this morning to confirm what she said on her email, she said she cant promise I will make my flight but she will do everything she can

Also a member of SOLVIT got back to me to say he sent out an email to the home office in my behalf but that he cant do anything till the deadline was hit by 10 days because they have to veriy that the application is not in the post


He did confirm what we all knew tho which is that if no decision is made by tomorrow the Home office will be in breach of the law

no news, they didnt reply to my email yet, and i didnt call them today so far. i will shortly and update what they will say.

Im on the phone now but as usual on hold for the minimum of 15 mins

Sameline I have my eyes on your decision as deadline will be over tomorrow. I never read this paragraph but it is simply written on UKBA website about "6 Months rule". It is really strange that how they are treating RC application.

Chapter 5 Residence card applicatin
5.1.8 Six-months rule
Community law requires us to decide applications for a Residence Card within 6 months from the date of receipt of the application. Every effort should be made to do so, particularly where an applicant draws our attention to an alleged breach of this requirement. Failure to comply with this requirement could leave the Home Office open to a claim for damages.

Well as usual she said she cant help me as no decision has been made, I called earlier this morning as well and another man said that i have to ring on Thursday as it is the day AFTER they received it

i just got off the phone with thm, the lady i spoke with was so surprised!!! and said: i never seen EEA application not been decided before the 6month finish, she made me laugh. Maybe she is new working there.

and i advised me to write letter to uk border agency complaining.


I am not sure if is going to help, cause every time you call they say different things.

yesterday when i called the lady told me my paper are in dept 45, today the lady i spoke with said she cant see any department and there is no fax number only by post.

they are so useless that they cant even admit they are breaking the law

I asked the lady on the phone and apparently she had no idea and couldnt advise on this.

I feel so helpless when they blatantly break their own promises like this

if you google that number ull see that it does go to them

but i faxed it to that number and sent a letter to that address

Just called back again and the apparent fax number dissapeared AND they gave me a different address

"European Case Worker Team"

Instead of

"European Case Worker"


They are so inconsistent!

No they didn't reply to any of the emails.

I am just thinking: yesterday they told me is been dealt with no decision yet and it is in dept 45.

Today: they can't see anything, only that there is application but "no department and don't know if is dealt with or no"

I don't know if us a good sign or no, I will have to wait until I call again tomorrow.

Did they reply to ur emails?

Nope but my MP said she is on the case but I dont think she can do anything till tomorrow

What do u mean they can see it, did you give them your ref number?

They normally tell u if doc have been sent out

what i mean that yesterday she could see that someone is dealing with my application in dept 45.

today she can only see that i did apply in 17 december but there is no note if someone is dealing with it and in which dept. only that there is application.

I dont understand how they have lost it, you should have called again as the answer just reeks of dishonesty, how can they just lose it. The very least which they say they do is give progress and they should have done that.


They are really inconsistent, this is exactly why they cannot have a phone number for complaints as they cannot afford to pay that many people to deal with them.

I wish someone would just pull their finger out and do something about it

Our 6 months are nearly up and still not a sign of life from HO. What's more, my partner's passport has not been sent back, in spite of the request submitted 1 June. He needed his passport for an important job interview today and was unable to show this. The HO have confirmed that they overlooked the request to send the passport back.

We are going to write to our MP, as their performance is unacceptable.

Ive emailed our counciler again asking for details for our MP because from tomorrow the home office will be in breach of EU Law

Its frustrating how they can be so cold and brazen to say yes we know we are breaking the law but there is nothing you can do but wait. It really is unfair and the complaints department couldnt care less

I have just counted, and i have 6 weeks to wait until the 6 months deadline! I hope they can get my RC to me before that! but i don't have a lot of hope after seeing how many December applicants there still are. :?

I think 20 days is more than enough time. it seems they are just ignorant, they have no competition so they don't need to do anything well or fast [/quote]

some more updates

I just called as the deadline is up and apparently our documents have been sent out this morning

but here's the kicker, they did not attach the next day delivery envelope that I sent to them recently

the lady said that they receive thousands of applications and they might have not matched the application to the envelope which wounds unlikely as I attached my ref number to it not to mention my address

I can't help but feel they sent it second class in spite, in the hopes that I miss my flight


regardless they have done their job and completed my application within 6 months so I have no claim if I miss my flight

hopefully I get it in time , I'm expecting it Friday or Saturday but we have till Tuesday to get it so I'm feeling just a tad more relaxed

Thank you! We were in a bit of a difficult situation. We have an additional wedding ceremony planned in two weeks time in my home country and we wouldn't be able to go if the RC didn't arrive in time. We were never informed of the 6 months time scale by our solicitor so when we found out in May we started contacting HO alot to explain our situation and ask them to speed the application process up.

In total we sent 1 letter and 1 fax (attaching tickets, rental agreement for venue etcetera) we also called them 3 times but got no help from that and wrote 3 emails that they never responded to. It must obviously have helped though :)
