Dependant's travel

Post by maya2812 » Thu Jun 21, 2012 5:53 pm

Thank you for reading my post. If I apply for my ILR whilst my child abroad is on a Tier 2 dependant visa will this affect her visa or her ability to enter the country. She was born here.

Making an application will not affect, but being granted settlement may.

After you become a settled person, the child may be refused entry under 321A(1) if entering UK as a PBS dependant.

So, to avoid any problems, best that the child returns to UK before you are granted settlement or consider deferring your application until the child is in the UK.
Life isn't fair, but you can be!
