ILR eligibility

Hi,

could somebody please advise if 4 years 10 months (hsmp+tier 1) or 28 days before the expiry of tier 1 extn is eligible for applying ILR?

You need to give more information if you expect a response that is helpful and exact.

When was your HSMP granted and was this a visa which you used to enter the UK or did you switch from some other immigration category? If it was the former, when did you enter the UK? When does you current leave expire?

Hi,

sorry for not providing full information, HSMP was granted on 05 March 2008, I entered UK as a student, and the current leave ( tier 1 extn ) expires on 05 march 2013.

What? You were granted HSMP but then entered as a student, or are you saying you had previously entered as a student but switched to HSMP on 5 March?

Hi,

Yes, I have entered as a student initially, later on in 2008 march, i was granted with HSMP, and the switched over to tier 1 when extending hsmp.

current tier 1 extn is till march 2013.

Based on the information now provided, you would be eligible for ILR 28 days before 05 March 2013. This is on the understanding that you meet all other ILR requirements including the maximum absences allowed during the 5 year residency period.
