I have couple of queries about my ILR application. It will be great to get your opinion about my situation. I did ask this question before, but unfortunately, didnt get even a single reply. Would be helpful if you can provide your inputs.
Info about me:
1)I got a Tier-1 general visa on 30th Aug 2008.
2)I entered the UK on 15th Nov 2008, so exactly 76 days after I received my Tier-1 visa
3)For almost 12 months (15th Nov 2009), I was unemployed seeking work in the country. During this time, I didn’t earn anything and was just looking for a job; obviously I do not have any salary slips/P60 for this period.
4)Additionally, I could not open a bank account in the UK, as most banks wanted either (a) an employer letter or (b) university letter to open a bank account. Since I couldn't provide both, I didn’t have bank account for first 12 months, and all my money transactions were done through relative’s bank account.
5)So effectively, I do not have any bank statements or salary slips for first 12 months while I was staying in this country
6)I got my Tier-1 extension done recently till 30th Aug 2013
My querie
1) Is it ok for me to apply for ILR even though I was unemployed for first 12 months and I won't be able to produce salary slips, P60 or even bank statements for first 12 month? So even though I stayed in the UK on Tier-1 General visa for the complete 5 year period (that can be proved by entry/exit on passport), I cannot produce the documents (Bank statement or salary slips for first 12 months). Can I still apply for ILR? How is the ILR clause of ˜economically active relevant in this case?
Your answer will be very helpful in deciding whether I should go for a 2nd Tier-1 general extension and then show 5 yrs of continuous employment or apply for ILR with the current situation where I can show employment for only 4 yrs.
