status when ILR is beeing processed

Post by touchwood » Fri Jun 29, 2012 11:00 pm

Hi there
My cousin is applying for ILR next month and his visa will be expired during the application process. Now the company where he works decided not to give him work untill he gets his visa renewed. OR he will have to provide a rule which clearly states that he is eligible to work in the UK during the visa is processed. Can anyone provide me with that clear rule. Many thanks

If he applied while his current leave was still valid, and his current leave permitted him to work, that status will continue until a decision has been made.

Provided that the in-time application was also valid.
