I looked at the post from one of the moderators after i posted the topic:when to apply.Sorry I should have read it before posting.

It seems as if I have to apply for an extention of my current leave to remain.i miss out on applying for ilr by 18 days in total.My workpermit was issued on 25 Sept 2007, but my leave to remain in my passport was issued on 31Oct 2007. I can't believe I am so so unlucky.Is there absolutely nothing I can do?Do I really have to apply for FLR as a Tier 2 migrant?

I looked on UKBA website, and the Tier 2 guidance notes.It all seems so confusing,and I am becoming more anxious.I am absolutely fed up.I am working for the same employer since 1st Sept 2007.

I don't know if I should give up and go home.I have a husband and a daughter at home and don't know how long I can hang around without them.On the other hand I have bills to pay and if I leave on in 4 weeks I will miss out on my deposit.I was just offered a permanent position,with a salary of £30100 per annum.Going back home and start all over, or carry on...I will appreciate a comment from anyone.I am on the brink of despair... :(

When is your current leave to remain expiring?

If you apply through postal application then these 18 days will be covered by virtue of Section 3C leave.

But this is not confirm, till the time you don't tell you brief immigration history. Like approval date, start of visa date, entry to UK, any leaves etc

thanx for the reply.My current leave to remain expires on 13 Oct 2012.I am not quite sure what you mean.Can you please clarify?

I came here on a working holiday visa, February 2006.I then applied for a workpermit the following year, 2007.It was issued on the 25th Sept 2007.My leave to remain was issued on 31 Oct 2007.I extended my workpermit, and it was issued in Sept 2008.then I switched to the PBS, and my Tier 2 visa was granted in August 2009.It will expire 13 Oct 2012.

Did you mean if I made a postal application for FLR as a Tier 2 migrant or if I make a postal application for ILR?I dont understand, because my question was, can I apply for ILR because my workpermit was issued on 25 Sept 2007, but my Leave to remain that year was issued on 31 Oct 2007.Can I apply for ILR, 28 days before my current leaves expires, on the 17th of Sept,or do I have to apply for FLR?Please be so kind and clarify this to me, as I don't quite understand.I was hoping to apply for ILR in person as my husband and daughter is waiting for me to apply for there settlement visas.What difference does it make if I apply in person or make a postal application?fact is, clearly in passport, my leave to remain as a workpermit holder was issued on 31st oct 2007.[/b]

Dear all,
I will appreciate it a great deal if someone can please give some advice or guidance.I was under the impression, for the past 5 years that I am eligible to apply for ILR on Sep 17th 2012, as my current leave to remain as a Tier 2 migrant expires on the 13th Oct 2012.

But my leave to remain the year I was given a workpermit was issued on 31st October 2007.This means I am 18 days short and need to apply for FLR as a Tier 2 migrant before I can apply for ILR.

Zahid.Ali.Anwar suggested that if I make a postal application, the 18 days will be covered, under section 3 (C).
Is this a fact?Should I take the chance and make a postal application on Sept 17th?I was issued a workpermit on 25 Sept 2007, and leave to remain on 31st Oct 2007.I know I am repeating myself, sorry...But I cant bear the thought of applying for FLR again, and spend another £500 or more..besides, I dont understand the rules for extending leave to remain, as stated on Tier 2 guidance notes.It is confusing.
Any advice will be greatly appreciated.Thank you in advance.

You may apply for settlement between 03-Oct-12 and 13-Oct-12.
