Hi,

I had applied for Tier-1 General Visa from outside UK in January 2010. I received my passport back in mid October 2010 (which was after 28 days from date of issue of entry clearance).

Date of issue (visa stamp date): 09/09/2010
valid till : 09/09/2012
Date of entry in UK: 20/12/2010.

I have read FAQs for ILR and it says that we can apply for ILR as long as delayed entry was within 3 months. But I entered UK after just over 3 months (by 11 days) and now I'm not sure if I would be eligible to apply for ILR after 5 yrs of continuous stay.

I have to apply for extension in Sept'2013 for another 2 yrs until Sept'2015. Is it possible if I can apply for another extension before I can apply for ILR?

No need to apply for second extension. Apply ILR using postal application. By the time they will decide on your application, the time required to stay in UK will be completed.
The question is... to be or not to be....

Thanks!! Can you also please guide me to where I can get more information on how to apply via postal application and their time scales so that I know when to apply.

Although it is quite early to think about ILR. However, you can read the settlement section of UKBA website.

This will provide answer to your questions.

Another good point of reading is FAQs for ILR - WP/Tier 2/HSMP/Tier 1

Yes, under current rules, you may apply for as many extensions you wish to.

Apply for extension by post close to the date of expiry of current leave. Since CW cannot backdate date of issue, by the time your application is decided it is highly likely your new leave granted may be last beyond the 5th anniversary of your date of entry in to UK.

ok,Thanks! that means I will need to apply for my 1st extension(around 1st week of sept'13) near my visa expiry date (09/09/13) by post. I know it is a bit too early to plan for ILR as rules may change by then but i just wanted to know if i have any chance!! Thanks a lot for your help!!
