Hi there,

As per my understandings babies born here with parent having Tier1 General can apply directly for ILR in the same application as for the parents? My baby born in december 2011. I will apply for her with my ILR application March 2013? Can you please clarify if it is all fine?

What about the maintenance funds? Do i need to show maintenance funds? If yes how much for main applicant + 2 dependents?

The following questions are related to my concerns:

Child born in the UK after either parent has been granted settlement: Is a British citizen by birth.

Q30 - My UK-born child has never applied for leave. Can I skip including him in the settlement application?
The important point is that children born in the UK are not required to seek permission, if they remain in the UK. Children born in the UK, who are not British, are not illegal entrants because they have not entered unlawfully. If they have not applied for leave to enter/remain in the UK, then they are not overstayers nor in breach of their conditions of leave because they do not have any conditions to breach; in principle, therefore, they may remain in the UK indefinitely! After settlement, register your child as a British citizen (as explained in the question above).

All above is well understood. But There are some points i got in my mind if you please have a look:

1- I phone the home office and they said you need to apply for your baby when you will apply for ILR. I intentionally mentioned that i was reading on immigrationboarads.com that i don't need to apply and that i can directly register my baby as soon as i will get my ILR done.

2- I Should skip baby from my ILR or i should not skip baby from my ILR, there is nothing like any hint/advice on UK Website?

3- What i understand is that i should apply for myself and my wife and later i can register my baby directly?

4- I don't need to get current nationality passport and ID cards at all?

5- I checked on calculator and it seems everything is smooth regarding scoring points and getting ILR successful. But is there any risk involved if skip baby (which is in fact a important point as it will save me to pay her application fee)? keeping both positive and negative results of the application?

I think you should consult some expensive immigration lawyer about this. People, on immigration board, share their experiance. Obviously expeirances can't be law. And quoting someone's experiance to homeoffice will not get you any relief. These are just for reference purpose only and does not constitute to any presidence.

thanks a lot. For me this forum is better option. thanks for your advice. I am quite satisfied with the suggestions given but there is no harm to discuss things further making sure things should not take unexpected turn. I hope someone will comment and i am also searching as "sushdmehta" suggests.
