ILR eligibility

Post by shreeimmigrat » Mon Jul 02, 2012 3:34 am

Hi All
I am eligible for my ILR on 21st July on HSMP tire1 general and my wife hasn’t finished 2 years dependent stay yet she is shot of 9 months so I have to apply for her FLR
Can anyone suggest if switching to FLR after 9th July mean have to wait another 5 years for her ILR

I am under a similar situation. I read the guidance and the FAQs but was unsure. I contacted a solicitor and was told the below:

The way I read the new rules, changing from dependant of Tier 1 to dependant of an ILR holder is a change in visa staus.

So I have applied for wife's FLR(M) now, so she defenitely stays on the course for 2 year ILR rather than 5 year ILR.
