Hi Sanghasaab,

My hubby had an interview, and when i siad i wanted to attend they said i wasn't allowed in the interview and as i had exams uptil 3-4 days before interview i did not attend, but i was not required to attend anyway.

i think every case is different and depending on Eco everyone gets asked different questions,

My hubbys interview was about 45 minutes, but was a very relaxed interview, I'll PM you my hubby's number and he'll tell you the questions he was asked.

Don't worry, stay calm and focused, hopefully u'll be ok :-)

Harpreet91 wrote:Dear all,

Follow to my wifes recent post.

Applied 13/04/12
Refused 02/06/12

From what I can gather from info from my wife and agent, visa has been refused with either or both of the following reasons. Not 100% sure yet.

Reason: english requirement not met or original document not supplied relating to proof meeting english requirement.

My wife sat;
International ESOL (listening, reading, writing) listening pass, reading pass, writing fail.
International Spoken ESOL (speaking).Pass

UKBA website states to show you meet enlglish requirement you must supply;
(3)
ISESOL Certificate
Plus
IESOL Notification of candidate results sheet.

This is stated on page 12 of UKBA approved language tests.

Both documents were supplied and I'm sure we meet the reqiurements. Or not?

My question are?

What is the appeal process?
How long does it take-best case scenario?
Do all appeals need to heard in court?
Can I visit BHC in person rather than going via VFS to discuss this issue?
Any other advise you can offer will be greatly appreciated.
Sad news, but no worries if its not a valid reason you will get your visa soon.

Looks like you are not 100% sure about reason for rejection, once you will get to know please share with us, as I am getting worried now.

I have also submitted mine English test report. I gave PTE Academic Exam, they don't issue certificates therefore we just needed to send the exam report and also to send it online from the PTE website but our agent asked us to send the e-mail with the report before our application, so it was 9 days before our application.

I hope everything goes fine and they check their mailbox and my exam report.

I am sorry but I don't have much knowledge about the appeal process therefore can't help you with it.

I had sent couple of e-mails to Mumbai BHC and finally I got a reply today.

"Settlement visa applications may take up to 12 weeks to process. Please note that that each application is dealt with on its own merits and it is left to the discretion of the assessing entry clearance officer to be satisfied enough to issue a visa and the processing time can be shorter or longer based on your application.

Yours faithfully,

Casework Team

UK Border Agency - Visa Services | British Deputy High Commission | C/32 G Block Naman Chambers | Bandra Kurla Complex| Bandra East | Mumbai 400 051"

Looks like a script to me...

For IELTS exam, do we just need to attach the official test report...would that be sufficient.

@Destination_London- As per the PDF on UKBA website you need to provide only the "Test Report Form".

Therefore,I think that is sufficient.

It appears as if not all required documents were supplied with application or have gone missing it got missed out.

The reason for rejection 'you have submitted a city & guilds esol certificate, however in order to meet our requirements you are also required to submit your statement if results for each module. You have failed to provide the latter and as such I am not satisfied that you have acquired minimum English language requirement.

Bad luck I know.

We will resubmitt required documents this week. How long will it take now untill they change there decision?

I guess it won't go to court. Hence no hearing.

Any feedback will be a great help.

@Harpreet91 My wife's first application was rejected because we submitted a copy of the english test results, not original. We made a fresh application because the grounds for appeal are weak as non-submission of certain doc's are far as I am aware treated as our own fault. and appeals tend to be for faults by UKBA or BHC.

Before you make an appeal make sure that you have the grounds for appeal and that it wont be rejected or refused and you have to make a new application in the end anyway. Maybe a good Idea to make a new application before new rules start on the 9th and may also be quicker than appeal

I've been advised I can appeal and the decision will be overturned.

Advised as long as required documents are supplied with appeal, they will not object.

Or do you disagree?

When our application was refused, an agent we spoke to said we could appeal but it was highly likely to be refused as we hadn't supplied the correct document in the first instance. However each case is different, you may have more grounds for appeal than we did.

Sounds a little fishy to me.

Hope you didn't pay him again to prepare your application?
