Hi,

I have the same situation, I applied for the Tier-1 extension and showed salary and dividend from my ltd company as proof of income. But the UKBA have asked for evidence around payment of NI.

I checked with my accountant and he mentioned that I do not need to pay NI because the salary I draw is below the NI level. I advised the UKBA of this and they have asked for a letter from my accountant. I thought this letter would be sufficient, however after reading through this I'm not sure if it will be enough. Any suggestions on what else i could do, e.g what should be mentioned in the accountants letter or any other documents i.e. P60?

Any thoughts would be good, because I need to send this letter soon.

Hi NRK, I have already submitted my application to UKBA. After reviewing my supporting documents, they asked me to provide evidence on NI payment. And my accountant tells me that I do not need to pay NI.

I could also be in the same situation.. my extension is in Sept.

I too draw a salary for which I do not have to pay NI.

Would submitting a letter from tax accountant suffice ?

ukba is right to ask about the evidence regarding your NI class 1 . The reason for that is you need to take at least full time earning - "not just part time or under the thrush hold " then you can take the dividend. call hmrc and ask them they will tell u this. As you income is below and hence you dont pay any tax and you have taken dividend for that you dont have to pay any taxes as your tax year period is not finished which is not the right way to do it

Thank you for your response. I was given a week to submit my accountant letter. Is there a way out now? Can I pay the NI now?

you should be ok..just phone HMRC and ask for the leeter for NI and tax contribution...otherwise ask your accountant to clearly states that....didn't you submitted your payslips...they do mention NI and tax..
