Tier 1 - multiple extension

Post by rangana911 » Sun Jul 08, 2012 1:33 pm

Hi,
I got my T1 General visa in Dec 2012, but only came to UK in June 2010 for a month long visit to test the job market and went back to my home country. In same year 2010, October, came to UK for good and since then, I Have being in UK, apart for 1 month i went out for holidays. my first visa extension is due in Dec 2012, which will give me another 2 years.

My worry is after that 2 years, will I be able to apply for another extension or will I be eligible to apply for Indefinitly remain ?

cheers,
Rang

Can you provide exact dates for the following to help answer your question.

Original EC Date = ??/10/20??
Date of First Entry into the UK = ??/06/2010
Date of Subsequent Entry into the UK = ??/10/2010

You can apply for as many Tier 1 (G) extensions (so long as you qualify with the required points at the time of the extension), as there is no limit on the number of times.

I asked for the dates to understand whether you would just require a single extension or two. Based on the information provided I'd say you will most probably need two extensions as you will have a short fall (for the 5 year ILR residency requirement) of approximately 6 months after the leave to remain on your first extension ends (Dec 2014).

What date did you leave the UK after your first entry on "30 June 2010"? If the time between that date and your subsequent entry on "01 Oct 2010" is no more than 90 days then your ILR clock will commence on "30 June 2010".

Thanks a lot for the advice cs95tdg.

I left on 30 of June, that is after 4 weeks stay.

So this means, i will have to get another extension after i get the first one on dec/2012. In that case, what scheme would I have to apply the second time. Is it under the new rules, which changed recently (which require very high earnings to earn 35 points) or the old scheme which I applied initially ?

I thought you said you entered the UK on June 30th in your previous post - i.e. see below. Was that the date of entry or exit?

Anyway I'll leave it to you to determine when your ILR clock starts after you've verified the dates. You can take a look at the FAQ sticky below:

Take a look at the following sticky along with the Tier 1 extension application form for the above question:
