Zambrano Help

Made zambrano application in december last year, returned for lack eof enough evidence of kids citizenship, since got passports for kids

What can I do now, advice needed asap

The documents submitted were my passport, daughters passport, prove of address ( t v license and sky bill). daughters full birth certificate, tenancy agreement, letter from the Gp confirming they know me as her mum and both of us are registered with them. letter from a relative showing them that they provide support since am not working and a covering letter from the lawyer explaining how i benefit from the zambrano ruling. Application submitted on the 4th of Nov and certificate issued on the 30th of November. Valid for 6 months

EEA Regulation 2006 amended without including the Zambrano judgment. I am becoming a bit concerned about UK interpretation of Zambrano :?

D amendment included zambrano, they called it derivative residence permit, its in 15A. Please check it out and give your explanations. From my point of view they included self sufficient to their interpretation.

That has always been there concerning other EEA nationals minor children residing in the UK. Their parents are not permitted to work whilst in the UK with them but Zambrano is about a British national child or children(well which UKBA has so far interpreted as their SOLE Carers having the right to live and work in the UK). I will still read along, I may be missing something here. But all the best to all in these times.

hello, I am new to this forum and need some help.
sent EEA2 appliation based on Zambrano, am an overstayer, father of the children. children are 7 and 5 British nationals. Married, wife has ILR. My wife works full time and studies part time. Previous Article 8 refused by HO.

EEA 2 application sent 21/05/2012
all submitted documents sent back today dated 5th July 2012:
stating:

" the documents submitted in support of your application clearly indicate that you are the British citizen's sole carer in the UK.
I am therefore returning these documents to you with this letter.

This is not an EEA decision under the Regulation so does not attract a right of appeal under regulation 26 of those regulations. UKBA will now be taking no further action on this matter."

I am baffled at this responce, could someone please help me understand why they did not issue a COA and the way forward.
your help will be greatly appreciated.

jlynn, hi I am a newbie, but I have being following this post for a while, n I have done my research well, the reason u have been refused, is because u r not the sole carer of ur children, u clearly stated that u are married, zambrano falls under single parents or carers of British children. they also feel that if u were to be absent in their lives, ur wife could take over...
If u ask me? u fall under article 8, human rights application, n u need a lawyer for this... hope this helps..

Thank you for your reply, just at crossroads now but will keep fighting on.

How long are article 8 applications taking for a decision, also because I am an overstayer will it not be an outright refusal.

Please advise on record proven solicitors that I can contact.

no it won't be, u need to get a lawyer, don't do it urself, n u have British children, so that is a plus, u have a strong case, don't be afraid, be positive...

Sorry forgot to add, if you are not making enough, you could go for legal aid, it's free, but if u have enough money, get a good lawyer( go online and check for a good one). and I have friends in situations worse than urs, and they were given dlr after their article8 application, but it takes a while though, ( so I heard) just give urself 6months to a year...

hi all.
Applied under Zambrano on the 30th of March 2012, didn't here anything from the home office till the 6th of July 2012. They refused my application on the gounds that I cannot prove that Im th sole carer of my British son, and that if I were to return to Zimbabwe my son will have to come with me. His father is in the UK and our relationship broke down beginning of the year. I have been the one to take care of my son, who is 2. I do not work.
In my initial application I included my sons British passport, letter from the GP, letters from the hospital from when he was unwell and I took him, letters from my aunt to say I live with her, 2 letters from professional friends to say im the sole carer, and some photos and bank statements.
Any advice will be appreciated on how I can prove that I'm the sole carer of my son, his father is in full time education and works full-time so is unable to look after him

what! that is just crap, they shouldn't refuse u at all, did you prove to them that you don't live with your partner? and in your post, did you mean " if you were refused your son won't have to leave with you" ? anyway i think you can appeal the decision, google it, this is just wrong, did u include ur son's birth certificate? ( sorry for so many questions )

thanks evie233. I applied using a lawyer, he says we should reapply and just add more information like the letter from the father to say he doesnt live with her, a new letter from the doctor and that I should write a statement.
I did include the child's birth certificate, in the application and I really thought my evidence was good enough as it was similar to the ones that others had sent. Maybe it just fell in the wrong hands.

yes I believe your application fell into the hands of someone who hates immigrants, because your case shouldn't have being refused, and pls if u are a christain, pray, if u are a Muslim, pray, if you are a budist pray( you get what I mean) I hope that your case is handled by a non bias person... fingers crossed..
