Hi guy's im posting this question for one of my friend who is in spain and applied for EEA FP and the high commission in madrid has asked him to get a letter head and bussines licence number,employment contract , and passport copy or some sort of id from the shop owner to determine its not a con. the shop owner who also happens to be his friend has a small market shop which doesent have any of the things asked for except business licence and also he is not willing to disclose his personal details by giving id or bussines licence number.
Question is are they allowed to ask by law all what they asking for ?????????? for EEA FP????????? if yes what is he supposed to do in this situation???? please shed some light on this all you great people thx.

I don't understand the relevance of the shop owner!. Can you elaborate further on this very sketchy story that lacks much information?

Employment has to be genuine. Is it so easy to demonstrate this by claiming to work for Joe Bloggs on his market stall?
A proper business will be able to demonstrate that you are employed by them as by law they must provide you with a pay slip with relevant reference details.

Employment has noting to do with an EEA FP. I think you need to wait for OP to explain why he is asking for this information before you go suggesting remedies to things that are not necessary.

Everything stated on an application has to be truthful. Each application form carries a declaration that must be signed.
It would appear the details of this business have been provided for some reason or other and so it is quite reasonable to ask for verification of anything claimed and backed up by a signed declaration of truth. It looks like they were right to do just that.

ok there is nothing fake with the claim here its just that this is a kind of a road side shop but in a market if you check this its shop no 17

its not a big business or anything and it just cannot afford to do payslips and business head letters or landline phone and all them kind of things that a proper business do so just dont know how to proof it and the boss of the shop (employer)is not happy to give his business licence number or his passport copy which the high commision in madrid is asking for but he is more then happy if they want to speak on his mobile visit the shop but understandbily except his personal business licence numer or id copy. when its someone else application... hope its clear now luca???
keffers....nothing is fake or decitful on the application that has been signed and i dont think its right to do so either.
atleast with the law abiding ukba and their consulates around.

Its not a case of anything being fake. Its simply someone requiring confirmation of what has been claimed.
Golden rule. When completing any form, think ahead to what might be asked and how you will be able to prove it.

A Spanish national does
not need to be working in Spain in order for his spouse to qualify for a family permit.
Requirements:
Passport (non Eu family member)
Passport (Eu citizen, not UK)
Marriage certificate

wife spanish
husband sri lankan. who applied for EEA FP on the basis of his spanish wife, in the FP application he mentioned of the job offer that he has in his friend shop in london, now the consulate in madrid demands for his potential employer bussines licence number, bussines letter head landline phone employment contract and bussines owner passport or some other id to prove who he is... problem is its a small road side market shop and it doesent have anything except bussiness licence......what shall he do in this situation ????????? thx.

This in itself is enough for a family permit. The Spanish wife has three months in which she has to be doing something meaningful eg work, be a student, be a self-sufficient person.

What the non-EU national plans to do in the UK is normally irrelevant. (The EU nationals plans are more important. For the first three months' residence, there are no conditions).

so what do you think? explain to the VISA OFFICER that what they asking is irrelevent and it will not be provided.
or
give them the full address of the business with owners mobile number
and the website for the market which is from people who owns the market

Why mobile number? I can confirm of landline phone and fax number in the shop's website that you have provided.

zubby... its not the shop website its the market website and their numbers..... this market have over 50 shops and and 1 shop is us and the management of the market will not respond to shops personal-indiviual calls.

You are focusing on the wrong issue.
The non-EEA potential employment in the UK is irrelevant to the application. OK, the applicant made a mistake and provided information that the consulate would like to follow but the applicant should remind the consulate that this is not required for a decision.

I suggest he make a fresh Application, he non-EEA doesn't need to provide any pre-employment address or phone numbers in the UK before EEA FP will be Successful Once both are planing to travel together or he intend to join her in the UK.

The Visa officer knew for sure that those things they're demanding are totally irrelevant in EEA FP application, in all your friend made an error in the application by filling in those unsure issues.
However he still have chance to withdraw or cancel the application and re-apply, the choice is his.

# and the only reason that job offer was mentioned because to show that there is a job offer too.
that surely dont give them a right to ask for employment contract , business letter head employer id copy and things..........

it can get rather complicated when friends rather than applicants post...
Nonetheless, you have the base information. Tell your friend to tell the ECO who doesn't appear to understand that they do not need to provide evidence of the non-EU's work proposals nor for the Spanish national for that matter.

I agree with you eu smile sorry about that its just that his english is very basic thats why i have to do it for him, what surprises me is he speak fluent spanish just in 2 years and he lived in uk for 4 before that..........
and yes they decided that they going to tell the visa officer that it doesent require the information they asking for, and what they can provide is shops full address and website add for the market they can check on.
