ILR time outside UK for dependants

Post by twon2is7 » Sun Aug 05, 2012 12:35 pm

Hi

my partner and I are currently 3.5 years into our Teir PBS with myself as the main applicant and my wife as dependant.

come two years I will satisfy the 5 years continuous residence and be eligible to apply for ILR.

My wife is planning on going overseas for five months. Will this effect her ability to apply as my dependant when I apply for ILR?

I will satisfy the maximum 6 months out of the country with no stay greater than 3 months but my wife will not.

I have reviewed the forms and can only see that the requirement applies to the main applicant and not the dependant.

Is this correct? can anyone confirm it?

thanks
