Query- is it possible to switch from PSW dependent to Tier2

Post by mnayak » Wed Jul 25, 2012 11:25 am

I’m in UK on Tier 1 (PSW) dependent visa and currently working as a server engineer. My employer is willing to sponsor tier 2 general, however i got a information stating, since I’m on a PSW dependent visa, I need to go to India and apply tier 2 visa. I have checked the UKBR web site and it no where states this information. Could you please clarify my doubt?
Thanks in advance.
Regards,
Maya

You have to apply for entry clearance in India and the position will undergo the resident labour market test and general limits on annual numbers.

Page 4 of the Tier 2 policy guidance lists the categories that permit switching.

Thank you for the response. I
I had spoken to UKBR yesterday and they confirmed that I can apply for tier2 from UK. I had cleared the entry clearance as PSW dependent and I’m currently working in London.
I really confused.

You cant switch within UK. all dependents have to go back to their home country for switching from dependent visa.

UKBA customer service can never be trusted.

i think when talking to someone, u should only mention that u are a PBS dependent.. when u spoke to ukba and said u are PBS PSW dependent, they would have thought that you are on PSW.. if you are on dependent of any sort, u have to go back to the country of origin and get visa..
plus ur company has to do undergo labour market test.. i say u tell ur emplyer about that.. get that done now, get the letter of sponsorship and only then go to the country.. maybe u can get leave from work for a month till the time u get ur visa processed back home..
i think when u come back, they will have to terminate ur old contract and sign a new one..
hope it helps..
