The court give me my appeal Number as well
I receive a letter from court they explain in letter like this
Any written evidence and submissions must be received in this office by 30/8/2012
if you have no further evidence or submissions no action from you as required.

A copy of the Tribunal Decision on the appeal will be send to you in due course.
maybe the court made Decision after 30/8/2012 i send my appeal on paper bases the court send the letter to Secretary of state as well i send my all supported documents original.
what about samelamin any Result for your hearing please update us what the court Decision

Actually i am in same situation like you. I have been refused for EEA2 then went into appeal. i submitted appeal on papers without a hearing. Court gave me a time to submit evidence by 13/08/2012. and i submitted all the documents. Let see how does it take. Any idea how long appeal takes to be decided? My solicitor said it take normally 4 weeks. I checked UKBA website it says same. but we never know sometimes they take longer than a month. What was a reason of your refusal ? Moreover I wish you all the best and I do pray for everyone and ask you do to same :) .

the reason is that why you do two time student visa extantion and you was say you living togeather but you send only your own name bank statemnt and i send them joint bank statment as well and the 3rd reason your partner not pay tax i alreay send my partner tax return documents thats the reason the case worker say i am not satistify your releashionship and i send 17 references from my friends tax returns documents all the supported documents can you send me the UKBA website link plz

Zahirsona what I understood that you sent only your bank statement. but as you said you sent your joint bank statement then it should be better because it shows your relationship stronger. and you said you have sent them all documents which shows that your wife is paying tax then why they did objection on it ? because the reason of my refusal that we couldn't provide them sufficient proof that my wife is self employed for example. bank statements showing regular income.. invoices etc...in appeal i have provided them all these documents. But i sent them my wife and mine joint account statement because to be honest my wife has regular income and i fulfill my expenses from it so that is why she credit her salary in our joint account. i hope they wont argue on it.

Zahirsona you have also mentioned that they are not satisfied with your relationship ? did they say exactly something like in the refusal letter that or you assumed that it can be ? just for my curiosity would you prefer to mentioned the nationality of your wife ? Because they if they say they are not satisfied with your relationship then I believe you must choose oral hearing so that you and your wife can convince judge.

The time taken to implement your appeal decision will vary, as it takes time for your file and details of the judgment to be collated and sent to us. If you have not heard from us 8 weeks after your appeal was allowed, please phone our European enquiries contact centre and we will investigate this further.

and my partner the same she work as self emplyeed and she put earning money our joint account and i am work full time my salary come to our joint account as well i send the more documents on 28th june tax returns but the case worker refuse me on 21st june how the case worker mansion this you send this documents my solicitors explain this matter as well and one more think the case worker say you extand your visa 2 time i was studying in uk i have my Certificate and also proof the college fee receed as well pay by card and pay by cash i asked to my solicitors he say not send the one he say if you send they well confeused so not send any more

Hello everyone

Ive got great news, Our appeal was successful, the only evidence the home office had was a piece of paper/ report from the registrar which was proved to be fake

we called multiple witnesses and in the end the judge allowed our appeal :)

we now have to wait till we get written confirmation then I will reply to the home office email which they sent me a while back garunteing that if my appeal is successful they will resolve it as soon as possible

so I will send them a scan of the confirmation and ask where to send my passport

Finally some good news, good luck to everyone here and feel free to ask me questions if you are not sure of anything

congratulation samelamin thats great news i am very happy for you to allow your appeal you say the home office send just one piece of paper and the home office representative came to court or not or they just send piece of paper you must claim all expenses and how long take time your appeal is successful like 2 month or above the court send me a letter if you wish to send more documents if not send no action from you the time for documents to send them they give me 30/8/2012 i already send my original supported documents with multiple reference letter with passport photo copy i think the home office make a joke with us the court letter explain we well send you a decision after 30 august 2012 today is one month complete my appeal submitted i think they take one month more once again congratulation and pray for us as well

Many congratulations, Samelamin.you must feel a lot of relief! Could you please vive more details of your hearing? My husband one is next Tuesday and we reales do not know what to expect...we have submitted same documents,just added the most recent ones,no witnesses as I need to prove I am exercising treaty rigths.

This is a quick summary of our court date.

We went in and our solicitor called my wife first and the home office grilled her with questions about our relationship like:

1) how long we have been together
2) describe our house
3) how often do we get guests
4) what we did last night
5) what we did last weekend
6) what we got each other for xmas ( we couldn't remember lol )
7) how often we see her family


and loads more, very hard for a fake couple to answer these questions to be honest, we had some discrepancies in our answers but they were perfectly acceptable as our solicitor said if we memorised our answers it would have looked dodgy.

Then they asked me the same questions, and we had loads of witnesses including my sister in law. The judge then asked her if she came specifically for the court and she said yes.

The judge then asked me to see the video of the wedding to prove that we did not need an interpreter (She had already seen loads of pics and statements)

At the end of the case she asked the home office lawyer if she has anything else to add.

The home office lawyer said that we could be really good friends and there were discrepancies with our answers for xmas presents to each other ( its bloody august! )

and

how we spent last weekend- my wife said things that we did and I said other things, we actually did both but I guess each of us had a different prospective of what we did


She also added that the registrar who is a government official who sent the letter had no reason to fabricate the evidence even though it was clearly proved that they did

She then implored the judge to dismiss the appeal.
This was the judges reply word for word

"I hear what your saying miss Johnson but due to the overwhelming evidence I am under no doubt that Mr **** and Mrs **** are a genuine couple. Because of this I will be allowing this appeal." The judge then looked at us and said " you will be receiving confirmation in writing in 10 working days."

And that's it, hopefully I get the decision before Mid August, so that I can reply to the email from the home office saying if I pass they will deal with our case ASAP.

I might make my next holiday in September :)

Sorry Zahirasona, I couldn't get back to you yesterday because of illness. First of all let me answer your questions which you asked me in previous post. Dear they mentioned all those self employment documents in refusal letter. So we submitted everything according to that in appeal. you asked me that appeal duration time which i wrote you so actually I took that point from the link which i send you in my last post.
No dear I haven't heard anything from tribunal so far. and CONGRATULATION TO SAMELAMIN. It is such a good news that he came out of big hassle. I don't know whether paper appeal takes longer time to be decided? I WISH YOU ALL THE BEST.

They should'nt mate but oral hearing might have given you more grounds to stand on

I would call them every single day but it normally takes atleast 2 working days after the date for the judge to enter in the details of the case and the decision .

Also so far I have not received any refund for my appeal and I am planning to take the home office to court if they make me miss my flight

Yes you are right. But my solicitor said in my case we should provide them a paper evidence because case worker did not satisfy with self employment of my spouse. Apart from it, I have question to everyone may be someone can guide me about this. My passport has already been expired in the possession of home office. Now obviously I am in appeal and waiting for its result. But hopefully (With the help of Almighty God) when my appeal will be successful then I know home office will take time to do paper work and then dispatch RC with all documents. But I don't think that they will ask me to provide them a new passport, they would rather issue me RC on A4 size paper which i don't prefer. So is there anyway that once my appeal would get approve then I can make my new passport through my embassy and send that to home office ? will it work like that ? does it make sense to anyone ?

I am in the waiting area of the hearing room with our baby sleeping right now,quite disheartening not having solicitor as we have no idea what is going on,how long we are still going to be waiting,my husband is "atending" other cases which makes him hey more anxious than what he already is. I just expect the chance to talk...

dont be nervous your in a relationship so there is nothing to worry about :)

I have emailed the complaints department replying to their email when they said they will give me priority treatment if i won the case

I emailed asking where to send my passport so that I can get to my holiday in September
