Break In VISA

Hi I have been in UK for 4.5 years and my visa is expiring Aug 25, 2012. My Employer does not have any opportunities now but say will have from 01-Sep-2012 in which case they are asking me to go back to India and will apply for new visa from there. My COS is already issued and is valid for a year. In case I go on AUg 20, 2012 and come back by 10Sept, 2012 can I still be eligible for ILR once I complete 5 years here inspite of this break of 20 days ?

If you already have a T2G CoS with a work start date of 01/09/2012 why don't you just apply for leave to remain before the expiry of your current leave (25 August). There is no need to leave the UK, your existing leave will continue until a decision is made on the extension application, but you will not be allowed to work beyond 25 August until such time that you get an approval letter from UKBA.
