Dual Employment - Is it legal?

Post by tapas_16880 » Wed Aug 15, 2012 9:21 am

Hi Guys - if this is the right forum to ask this. But thought I will have an answer.
If someone hands over the resignation/notice and then is not required to come to office. Company keeps on paying the salary for the next 3 months (notice period = 3 months). Now, during this 3 months, can he/she join another company and have dual earning.

Obviously, since the first employer will send P45 at the end of 3 months, so, the person will be under emergency tax for the period he will be employed till he/she hands over the P45 of his/her previous employer.

But from HMRC and immigration law perspective, is it legal to work for another company when you are still receiving the pay from your previous company or it is purely illegal?

Thanks,
Tapas Sarkar,

Under both immigration and general employment law, you can have as many jobs as you are able to cope with, and all at the same time.

But in that situation, one can't be on a particular tax bracket for all the employments. Do you agree? I mean, if one is doing 2 jobs at the same time, for one of them he will under a certain tax code but for the other job, he will be under emergency tax bracket. Is this correct?

Yes, but that is not what you asked. You asked if you could be simultaneously employed by more than one entity .
