EEA4 Application Question

Post by siddiqr » Fri Aug 17, 2012 6:51 pm

Hi All

I am Looking for some advice on my EEA4 application please.

I am Pakistani national married to a Norwegian citizen since 15 aug 2007.
My wife has worked continuously from sep 07 to jun 12. In June 12 she accepted a 3 months contract work in Norway. She is returning to UK on 9th sep. Upon her return she will apply for jobs again.

My questions

1. In terms of my wife exercising treaty rights, would her 3 months work in Norway cause any problems? She did the same thing in 08 for 2.5 months.

2. Section 8.2 on EEA4 form requires both of us to record all travels in last 5 years. I realised how difficult it was when I sat down with both passports. We both have travelled extensively in last 5 years, sometimes alone and sometimes together for work and leisure. My passport is a mess with half omitted stamps whilst my wife's EU travels are not even recorded as she never gets a stamp in her passport. I want to provide HO all the info they are asking for but this task is becoming increasingly difficult. Any suggestions or experience sharing will be greatly appreciated.

Thanking in advance
Riz

Please read directive 2004/38/ec. The answers to your questions are there.

1. Temporary absences up to 6 months per year (more in exceptional circumstances) are allowed. Your wife will need to explain the absences and kikely also show that she has not given up residence while abroad.

2. EEA regulations do not require a travel history. That's an invention by the UKBA. You need to show continuous residence. A Residence Card holder's passport is not allowed to be stamped.

Hi Riz,
I am having the same issue with logging all our travel. I didn't really understand the 2nd reply to your question and am wondering if you found out anything useful?

Many thanks in advance
