PLEASE HELP ME ! URGENT

Hi
Plz help me as i am very confused regarding new rules which came in to affect from 9th july 2012.
i came here in 2002 october as a student and still tier 4
student level 7.i have done recently my last extension as a pbs tier 4 and
leave granted up to june 2014 but i am not allowed to work and curently
i am not working.
and i have my wife who came here as a dependent in 2005.
my son nearly 6 year old and a daughter 2 month old.
we are going to apply after 14th of sep for ilr 10 year long
residency.
Do i need to show income as i am not working but my wife is allowed
to work and she is woking but we dont have much savings.
both kids born here and son is going to school full time.
please tell me what will happen if we apply fo ilr without
any income or do they consider my wife job and earnings.

You will need to meet the income threshold for yourself and 3 dependants otherwise your application will be rejected. The fact your kids were born here makes little difference as in the UK being born here does not give one the right to citizenship.

your answer is totally wrong.

1) The OP will fall under the old rules and more over he don't need to show income for his ILR

2) Once the Op gets ILR, he can register his kids as british citizen using MN1 form

3) His wife will also fall under old rules, because she has been granted entry clearance or extended her visa as PBS dependent before 9th July.

4) She can apply for 2 years settlement visa ( not 5 years settlement visa as new rules states)once the OP gets ILR and moreover they don't need to show new income threshold as i explained above that she has been granted entry clearance before 9th July 2012

First of all, 10 years long residence ILR application are individual applications. So only "you" can apply not "we".

The only requirement for 10 years application is that you have lived in UK lawfully for ten years, have passed LiUK test and made an application. There is no requirement for working or earning or anything. Basically you could be a penniless destitute unemployed, but still will be granted ILR under this category.

Once you get ILR, any children born in UK can be registered as British Citizens using form MN(1). There is no need for any other kind of visa extension or ILR for children to be registerd.
