Dependant Visa question

Hi,

I recently got my ILR, before that I was on Tier 1 (G). My wife is on PBS dependant visa valid till Apr 2014. My question is, do I have to apply for her FLR(M) visa now or shall I wait for 6 months when she would qualify for her ILR after completing 2 years in the UK ?

Any help would be much appreciated.

Paragraph 319E of the immigration rules, with regard to the requirements for PBS dependants to apply for ILR. It does not get any more authoritative or reliable that that.

The reason you might be getting mixed answers is that before the rules changed on 9th July your wife would have had to switch on form FLR(M) but they specifically changed the rules so that this is no longer necessary if the spouse will qualify for ilr during the currency of their PBS dependent leave.

Drag/hi-light 319E of the immigration rules then right click and choose search google for 319E of the immigration rules Should be top of list.

I am in similiar situation, I have got ILR and wife has Tier 1 dependent visa till 2014 and she will be eligble for ILR in 2013 April. I asked the same question to my caseworker and he replied that she does not need to apply for any FLR and she can directly apply for ILR.
But keep in touch and if I know anything else will let you know

Thanks. I'm guessing we don't have to apply for an FLR(M) so long as the original Tier 1 dependant lasts until the spouse becomes eligible for ILR.

Did you get ilr as a PBS migrant or under the 10 year rule.

I had a WP, an HSMP and then Tier 1 before getting my ILR.

Ok- so did you apply for ilr as a tier 1 general migrant or did you apply under the 10lb year long residence rule?

As a Tier 1 holder. I havent completed 10 years just yet.

Then yes your wife does not need to apply for FLR, she just needs to apply for ilr once she competes her two years.

hi, I have PEO appt end of this month and she will apply for ILR Next Year.

In this case can dependant partner travel outside country? Lets say we travel in December and I would be on ILR and she would be on Tier 1 Dependant visa.
