Tier 1 General Extension (Directors Salary)

Hi All,

I was first granted Tier 1 General on June 2011, which is due to expire next year. When I first had this visa I was an sales employee of the company and therefore I claimed previous earning points based on my PAYE (before tax £36k).

My current position in the same company now is as a Director with 50% share holding. I am withdrawing salary and paying tax via PAYE taxation system. I can not pay myself dividends because company has been making loss from past 3 years. Also I am registered as a self employed, while filing my personal accounts (self assessment) I declare the income which I have earned through PAYE.

***The reason I registered for self employed was to save employer's NI. I thought if I withdraw the gross salary every month and file my own tax returns, then the company don't have to pay employer's NI***

To score 20 points for previous earnings my income should fall between this bracket £35k to £39,999. Of course as I have said earlier my annual gross salary is £36k.

My question is, when applying for an extension, would it be ok if I just put myself as a Director of the limited company with Gross salary of £36k? Can I still claim 20 points for it? Also, I can provide P60 along with my pay slips.

Please can someone confirm If I am on the right track? or is there anything better to make my life a bit easier.
