my current visa is 3 years discretionary leave, which expire next month, my solicitor want to apply for ILR under Long residence ? whcih I dont exactly know how it is going to work?? Ok you need to extend your current discreationary leave for another 3 years. After those 3 years you can apply for ILR. You can extend your discreationary leave under new rules. Only new applicants can't have discreationary leave so if your legal rep is telling you otherwise then he/she is either lying or doesn't know anything. I have spent 10 years, but I had gaps in in my visas even I never left the country throught theses gaps. I applied in 2009 for the 10 years long residence and refused due to these gaps( overstayed) and appealed and got the 3 years discretionary leave.sushdmehta wrote:No. Only after 6 years.
