Plz someone help me MBA provision extention tier 1

Plz someone help me MBA provision extention tier 1

iam going to apply my Tier 1 extention. my previous extention was on behalf of MBA provision 75 points.

now i want to know i will get 75 points for my qualification or not because i did mba from bradford unicersity school of management.


Law says:

There may be a very small number
of applicants who are currently in the United
Kingdom under Tier 1 (General) or the Highly
Skilled Migrant Programme and whose
qualification has previously been assessed
to be of a higher level than shown by the
Tier 1 (General) points based calculator.
These applicants may claim the higher points
score, in line with the previous assessment,
provided they are using the same qualification
as used in their initial application. Appendix A
paragraph 17 of the Immigration Rules gives
more details.
61. An applicant who is not sure what
points he/she was previously awarded under
the HSMP should contact the Customer
Contact Centre on 0114 207 4074.
62. In these cases, we will refer to our
records. We will only be able to award
a higher points score where each of the
following requirements is met:
• the applicant is currently in the United
Kingdom under Tier 1 (General) or the
Highly Skilled Migrant Programme;
• the applicant is relying on the same
qualification for which we previously
awarded points in this area;
• the earlier assessment of the qualification
confirmed that it was equivalent to a higher
level of qualification than is now shown by
the points based calculator; and
• there is no evidence that the applicant
used deception to obtain the earlier
decision.



one of my colleague got straight forward extention without age and income points but he is not incontact with me.

you would score the same point as you have scored last time when you applied/extended your visa and your application was approved...

now lawyers are saying that I would not be able to get same poits for my MBA degree(75). they are saying it was only for intial application. please help me in this matter.

have you used point calculator to check how many points you ate getting..

Dear, when I got tier 1 general on behalf of MBA Provision, there were no 75 points for MBA of POINT based calculator. same is now.

then you should be Ok..phone UKBA to confirm....this is transitional arrangement..can't understand why you wont get those points...

MBA provision 75 points is only applicable for initial application. At extension you'll be able to claim only relevant points for Masters, and rest you need to accumulate thru age, earnings etc.

When the UKBA guidelines have made it clear that applicants who have been previously been assessed 75 points for the MBA degree, may claim these higher points in line with the previous assessment using the same qualification.

My query is:
Why is the MBA provision for 75 points then only applicable for the initial application? If this is the case then, the UKBA would not have mentioned this exception in the guideline, that the applicant may claim the higher points score as in the previous assessment. Surely this point will hold up legally?

Can administrators/moderators also please advise on this query?

Because those were the rules when the MBA provision was set. It is only good for the initial application. Surely, you don't think you can keep on getting extensions by just showing the MBA certificate? The UK would like you to prove you are a highly skilled worker.

This quote relates to some exceptional cases where a higher points were granted in a previous application due to differences in the educational level (for example a Master degree in a foreign country that is recognised as Phd level for the application). I don't think you have any legal ground here just because of the wording in the guide.

Hello pmmunir92,

By now you must have been through your extension process.
I am in the same position now.
The institute from which I did my Masters (for which i was awarded 35 points in my initial application) does not appear in the drop down list of 'qualification' now when I calculate the points on UKBA site.

Kindly let me know what did you do in your case.

Senior members and moderators kindly shed some light on this.

I thought the MBA provision is now only open to Bulgarian or Romanians Points assessment for highly skilled people

I have got my extension on 11-01-2013. my case was entirely different, intially I got 75 poit for my degree, now I got 35 but still my uni is available on calculator. If u intially got 35, on extension u will get automatically 35 for ur degree. Please tell me ur uni, so we can guide u. u can email me on pmmunir92@hotmail.com........if u have any querey.
