Absolutely 5 years required for ILR?

Hi guys,
My tier 1 general visa runs out 26 Sep this year, I entered the UK on 19 Jan 08... that makes me 4ys 8months resident in UK. I want to apply for ILR under tier 1 general but was told I am not up to 5 years continuous residence in UK. Can I send in my application by post, knowing that it takes them 3 months or more to decide an application these days... and by that time I will have completed the 5 years requirement?

Did you enter the UK within 3 months of your Tier 1 EC date?

No. I entered in Jan 2008, EC was granted Sep 2007

While it is true that postal applications take longer to process and can be advantageous if you have a small short fall in "leave to remain", your gap is around 4 months, therefore IMHO you will need to apply for an T1 G extension to cover the gap.

The whole thing is very confusing.
Does this mean I have to apply again for FLR under Tier 1 Gen? That will make it 2 extensions!

There is no restriction on the number of extension applications you can make. You can make as many as you need to.

Thanks cs95TDG... one more question pls... is it possible to get an PEO appointment for FLR T1 G extension within a couple of weeks (maybe by going through a solicitor) as its so difficult to get a PEO appointment within 6 weeks!
I need to travel out of UK.

Getting PEO appointments is always challenging, but it can be done. If you are however looking for one for two weeks from now, then the chances are low. If you look through this forum, you will see many posts, with user experiences, on what time to login and how best to go about getting getting the PEO appointment you want. A solicitor may be able to get one with greater ease, if you are unable to find one yourself & require one urgently.

I took out my Tier-one in October 2009, and entered the UK a month later (after registering with police, and stamping my TIer-1) and then left. FInally settling in the UK A year later in september 2010.

Do my 5 years to ILR start in 2009 or 2010?

The obvious reason why this is important, is that if 5 years start in 2010, I will be required to extend my Tier-1 again, in 2014...
