received mail from HO

Post by crazyjack » Thu Jan 11, 2007 10:08 am

Hi Anil,

I too had given my work address in my application form and I received mail from caseworker that they can not communicate in office address so please provide residence address ASAP.

I replied then back with my Residence address along with the reason why I had written work address in my application form.

Afterwards I didn't receive any response from their side.

Hi Jack,

I replied exactly like you did. However, today I called them and explained the email that I had received and that I would prefer that docs are sent to my work address. She responded that they will be sending to the work address indeed. Also told me that it would take another 1 or 2 days before a decision is made on my application.

Fingers and toes crossed till then

Hi Rbg,

I did not need to, since one day after I received my reference number, I got an email from the caseworker regarding my address (see my post above). So I know it is with a caseworker.

Cheers

past earnings

Post by jenwaller » Thu Jan 11, 2007 6:23 pm

I got my refusal today

No points awarded in previous earnings

cos the *$@%#& caseworker said I didnt attach any income tax return which i did (dont know what the hell he is talking about) I explained that the tax year in my country is Jan - Dec so I used employers letter and payslips for the rest of the months not covered.

No points in age

cos I lost my Birth Certificate in a tribal clash and didnt provide evidence of this (even though i sent notarised pages instead and explained but they want evidence)fair enough 8) .

No award for English Language even though I sent letter and original transcript from my UNI cos I havent been issued my certificate ( I stated this in the form)

I called HSMP team and the lady who picked up told me they reject if theres any reason they can think of and only 30% are being accepted. Which is not right they actually look for a reason to reject even though you have provided evidence and explained that its exceptional circumstance.

I;m not wasting my money again I think the QUEEN is rich enough
I would advice anyone to explain everything in the cover letter and PRAY

Hi Mate,

This is very bad news in your case. They have not considered age proof, salary earnings and english language requirement from univ letter.

I think so most of them are doing the same.

My ref no: 203XXX. I will update once i will get soon.

With heavy heart, would like to convey to this forum that, i got my refusal today on grounds of EARNING and education.

Really ridiculous reasons to reject some app. I was really shocked to see they r doing so.

They say u didnot provided evidence hat ur degree is obtained.
Man I got NARIC evaluation positive and gave them th reference no for verification as my NARIC letter was late. But they didnot tried to enquire about status from NARIC on there own.

They say i stated i am not providing required evidence for last month.
Why shud I state so

ITR missing
Form 16 was attached till dec 2005, after that exceptional consideration claimed

Exceptional consideration reasons in-appropriate.

One thing, i can definetly say, HO ppl r completely blind. Rejecting for baseless reasons.

I will file a review, let see wht happens

Hi Paramjit,

I am so sorry, to hear about your rejection.

Can you please share some more information from the letter that you got from HO?

1) They say u didnot provided evidence hat ur degree is obtained.

Is this the reason? What is the evidence required, you sent the Original Degree certificate, right?

2) They say i stated i am not providing required evidence for last month.

Is this for the earning section?
Why do we need to provide the outside claim period salary evidence?

3) ITR Missing.

Now, it is confirmed that ITR- SARAL is the required evidence.
One should send all income Tax related docs. to be sure of points.

Very dishartening....they always give some absurd, reason for rejection.

hope your review request is approved.

Are you planning for any fresh appl. or only review?

So sorry to here this dude :( It's really shoking.
The one you are talking about got rejected because his/her SARAL was just stamped, but NOT signed.

Is there any case which got rejected with Stamped+Signed SARAL too?

What documents had you provided for earnings proof? Can you describe in details?

thanks and better luck next time!

Hi,

It was me who got reject because of ITR even though I submitted SARAL form with STAMP of ITO (Income Tax Office).

In my letter they did not mention that there is no sign on that. The words just says....The ITR Submitted by me is not Original.

I had sent a review request explaining the procedure followed for ITR in India. Below is the letter I had sent to them....

----------------
To,
The Officer,
Highly Skilled Migrant Programme,
PO Box 3468, Sheffield, S3 8WA

Dear Sir or Madam:

Sub: Reasons for review of my application (HSMP Reference# 2022XX)

With reference to the above subject, I would request you to review the decision made against my application. The reason for my application refusal as per your letter dated X January 2007 is that: “Income Tax Return form I have supplied is not an original.” In this regard, I would like to CONFIRM that the Income Tax Return I have submitted is the ORIGINAL DOCUMENT and also would like to explain the process followed in India for Income Tax Return Document.

1. At the end of the financial year, the employer gives employee, a Form-16 which will have the details about the income received and the tax deductions made during the year.
2. Once Employee receives Form-16, he need to fill up Income-Tax Return form (called SARAL) with his income details and submit the same to Income-Tax office along with Original FORM-16. The SARAL form needs to be filled & submitted in duplicate.
3. Once Income Tax Office receives the SARAL form, they validate the same and return DUPLICATE COPY of the SARAL with a Seal of Income Tax Office (ITO) on it, as acknowledgement and is considered as Original Income Tax Return Document

So in this case, I had submitted the SARAL form I received (For year 2005-2006) from Income Tax Department with a seal of ITO on it along with my initial application. I am resending you the same document for your review.

I am also having my previous Income Tax Returns forms for the years 2003-2004, 2004-2005 in the same format. I would be able to submit the same for your reference / verification if needed.

I am attaching a sample blank SARAL form (which has instructions at the back of it) for your reference. I have highlighted the instruction #1, which confirms the explanation I have given above. (This form can also be downloaded from http://incometaxindia.gov.in/ , which is an official site for Indian Income Tax Department or using the link http://incometaxindia.gov.in/forms/2d.pdf )

I would be grateful if you could review the decision made for my application with this explanation / justification in accordance with the HSMP Programme guidelines.

Thanking you,

Yours Sincerely,

----------------
