The residency requirements for naturalisation state quite clearly that in order to meet the requirements for naturalisation (on the basis of 5 years residency in the UK) the applicant should not have been absent from the UK for more than 90 days in the last 12 months and in addition the total number of days absence for the whole 5 year period before application should not exceed 450 days.bluemadimor wrote:hello everyone,
I got my ILR in OCT'2004 and after that i left to India in Nov'2004. came back to UK in Jan' 2006.
Now will i be eligible to apply for citizenship?.
My Son has got the citizenship as he was born in uk.
Are their any claus under which i can apply for the citizenship even with this absence in uk?.
Thank u.
How is your day count looking in 100 days time? For example if you were to apply say 20th April, is your day count then below 450 days? And indeed were you physically in the UK exactly 5 years before IND would receive the application, that is, on Monday 23rd April 2002?i read the document and calculated all my absence its coming to 546 days till today
No, you are misinterpreting that. For example, you must not apply for Naturalisation during the period 12th feb'07 till 2nd mar'07 .... simply because you were absent from the UK from 12th feb'02 till 2nd mar'02. As regards that particular test, it is as simple as that.If u say physically present in uk that will come to 5yrs and 6months after removing all my holidays.
i have all valid work permitts of my stay and as i first came to uk in april 2000 till this april 2007 i will be completing my 7yrs of saty in uk,We will disregard absences upto 900 days(540 for husbands wives or civil
partners of British citizens) only if u meet all the other requirements and you
have established your home, family and a substantial part of your estate here.
we would also expect that:
if the absences are upto 730 days we would expect you to have been resident
in the UK for the last 7 years.
