my case is also similar , they are not saying yes or no just keeping with them.

I am keep on mentioning , i applied my tier1 extension with that figures only . that time ukba did the same inquiry and approved my extension . but still my application is in pending state. i requested many times that if they agree i can submit further evidences and can attend personally PEO to explain my case. but no response.

I had one absence > 90 days. I went on a business trip for 55 days and it prolonged for 143 days due to my illness abroad. I provided docs certificate and the medical records of hospital treatment with my initial application but the cw said I will have to pass this to further check team to check on doctors certificate. She said rest of the docs are all fine i.e. earngings, co habs etc

Hi Guys Can imaging your enthuasiam.......

Let under the case.

I have applied for ILR as PEO on 21st Aug.

I was on WP between 4th aug 2007 and 23rd Feb 2008.

During this time was away for = 90 days. CW on the day got me incorrect days of absence =>90 days how. My passport stamp shows 24th Nov and 23rd feb.......but CW comback with dates like 21st Nov and 23rd Feb which is wrog assumption on there side.

As I was ON WP CW asked me for letter from previous employer.....

I had replied to UKBA next day expaling the LAW and why do they need letter as absence was exact 90 days.

I think they might have realise the mistake and process application quickly.

yes its from abroad but it has docs email/phone number on it. so they can verify that in just one day. In fact they could have verified at the time I submitted my application.

It is really frustrating , No response and no call from UKBA.
Almost 14 weeks completed. Not understanding what they are assessing and why they are taking more time to take decision.

Hi Krishnalvr

14 weeks is a long wait especially if you have paid premium fee like me. UKBA website clearly says

"If your application is straightforward, you will normally receive a decision on the same day as your appointment - see below. If we cannot make a decision on that day (because your application requires further enquiries, or we are having technical problems), we will decide your application on the next working day or as soon as possible"

what I understand if the application is not straightforward then the decision should be made next day or asap.

I read your previous post about complaining to PEOComplaints@homeoffice.gsi.gov.uk. Can you please tell after how many days do they reply if you complain on this email.

Regards

i have received first response from UK BA on July 30th stating that my application is under active consideration through my MP

2nd Response on 30th August with regards to my complaint sent on August 14th stating that my application still being considered .

3rd response on 31st august stating that they required further assessment regarding my earnings . But the same were submitted during my tier1 extension in OCT 2011 and approved the extension.

my mistake is, i used to draw 80% of invoice amount as my accountant suggested . during tier1 extension the case worker told me that i am fine with the letter given by u r accountant and suggested me to draw the salary and dividend in separate component. i am doing the same since from Nov 2011.

I replied on 31st August stating that i can attend personally again and can submit further evidences regarding earnings but no reply and no response till date.

I don't know what assessment they are doing and to whom they are contacting.

they are taking ages to take decision.

If your Accountant has verified all the earning information then it should be recognised especially if he is registered with the regulatory body.
There are so many ways you can withdraw money from the business i.e. dividends, bonus, salary etc
This is what I think (I may be wrong) they couldnt understand what you explained to them and they are trying to evaluate themselve.

My accountant consultancy is big firm. When I explain my home office query to them, they are saying that this is the first time we hearing this kind of explanation that query and we are working for many ppl and provided many letters, we haven’t seen this kind query like that they are saying .

If they can’t understand the figures now, how come the other case worker understood the same figures when I submitted during tier1 extension?

If they are trying evaluate the earnings how many days they will take to evaluate. To get an idea about my earnings they need to contact either my accountant or company’s house or HMRC or me for further documentation. They are not doing any thing till now; simply they kept aside and pending.

My accountant clearly mentioned in the letter ,how I have drawn the amount till Oct 2011 and after words. If they see the figures and evaluate after 100 years also, the figures will not change.

I also mentioned in the covering letter and mail that i am ready to submit further evidences if they required.

If they can’t understand, they have to reject my application by saying that we are unable to take the decision by seeing your earnings. They are not doing that one also.
