2nd Tier2 ICT extension in 2015 and ILR

Post by manish11 » Mon Sep 17, 2012 7:11 pm

Hi All,

I was granted and entry clearance (Tier 2 ICT) on 15th March 2010. I travelled to UK on 11th April 2010
My extension is due in 2013 and I would need a second extension to complete 5 years for my term for ILR

Please advise me what would happen in below situation

Extension in 2013 would mean I would automatically switch to long term staff with levy of job level NVQ Level 3 + and salary of less than 40K
As per the UKBA guidance my second extension would be under long term staff category (my last leave) will my job category need to be NVQ level 6+ and salary 40K plus for this second extension
Will I be able apply for ILR in Marh 2015
Regards
Manish

Your application for extension and ILR will be successful only if you fulfil the eligibility requirements for the respective applications on the day of such applications.

No one can tell you today what the rules will be in 2015. So, comeback nearer to the time of extension in order for someone to offer any usable suggestions / answer queries definitively.
Life isn't fair, but you can be!

I would agree with the reply as rules are due change in coming years

The reason for my Post was the latest guidance and to find out an optimal time to apply for my first extension and possibility of ILR under current rules(keeping in mind the rule may change) trying to avoid a second extension.

Am I eligible for ILR

Post by manish11 » Sun Jan 25, 2015 11:25 pm

Hello team,
Following is my situation
Entery clearance granted on 15 March 2010 on tier 2 ICT until 15th March 2013
Entered UK on 11 April 2010
Further leave to enter (visa extension) was granted on 12 March 2013 until a 15th March 2015 tier 2 ICT long term staff

As per HO guidance Looks like satisfy all the criteria however I have a doubt wether I satisfy the condition of time spent under rules before 6th April 2010

Please can you advise the term time spend under rules before 6th April 2010 does that mean EC granted before 6th April 2010 or I must have physically entered the country before 6th April 2010

Regards

I think it relates to when you made the initial application.
