EEA2 overstayer

In the process of filling in the EEA2 application form as I'm married to an EEA. I'm an overstayer by 1.5 years, will the border agency keep my passport or refuse the application based on this?

Only if they suspect MOc they will refuse your application even if your eea spouse is exercising treaty right. To be on a safer side, include enough evidence to show marriage is subsisting but it is not compulsory.
