Tier 1 -Maintenance Fund Query

Hi All

I have query in regards to my Tier 1 maintenance funds. Me, my wife and Kid are living with me since (2010) I came here in UK. I will be going for extension in Mar 2013 next year. So If I am right the maintenance funds to be shown will be as below and it has to be in account for not less than 3 months:

Main Applicant: £900
Dependent 1: £600
Dependent 2: £600

Please update!

Visa File Query

Hi Seniors

Is that okay to file extension just 1 week before the actual expiry date. I would be doing it with 2 dependants as well. The reason behind this is I arrived UK on 76th day of my Visa stamp date.

This would benefit me for ILR even though its case workers discretion.

If someone can put some light on it, even though I know the answer is yes !

Applying anytime within the 27 days preceding the date of expiry of current leave is fine.

If a valid, in-time application is refused in circumstances you refer to above then you will be given a right to appeal.

Say my initial leave for Tier 1 is expiring on 31 Dec 2012, If they receive my extension application by courier on 28 Jan 2013 or if I apply by post office or PEO on 28 Jan 2013, will it be considered in-time?

If applied at PEO on 31 Dec 2012 and refused and given right of appeal, can we still re-apply for extension during these extra 28 days or appeal would be the only option?

The Maintenance funds for my dependants can be shown from my current bank account right.
Or else it can be shown from theirs ?

SECOND QUERY:

I am on Tier 1 going for the extension on Feb 2013. My initial visa was granted on 12th mar 2010 and I arrived in UK on 27th May 2010, so I would say gap of 76 days.

1. I am going to India in december, days will be 24. So total days which i have been in india will be 76+24 = 100 days, which exceeds the 90days ILR criteria.

2. My visa expires on 12th Mar 2013 and i will be applying between the dateframe 4th to 8th Mar 2013.

So do I have to still apply for second extension or I can apply for ILR ?

You can be absent for a maximum of 180 days in 5 years period. You can ignore the initial 76 days, as absent are counted after you arrive in UK.

Its alright to apply during the dates you specified. However, you can apply 28 days prior to your expiry date

As stated above, you don't need to apply for second extension if you are absent for 180 days in 5 years period.
