Thanks, for 3- tax returns, which form did you send? the one you have to fill in and submit to the gov't, or the one you received after you submitted the earlier form?

Hi Param,

I feel sorry for your decision. But take this in positive only, May be God has saved you from this.. File your review explaining why you feel caseworker's decision is wrong, but start looking for other possible alternatives.

This is not End of World , You may get more better opportunity than this !

Yeah i have already kept few alternatives in view. Like I feel India is becoming an option to settle down.

My ref number is 2034** and it seems that it has been allocated to a case worker on Thursday since I got a mail from them asking about my address. So, I can't figure out their queuing system.

But here is the confusion, They are allocating by sequence or randomly. I have seen some posts in this forum those who have ref no like 2028XX or 2026XX not assigned to case worker.

How come urs assigned 2034XX. Just clarify,...
I have sent today additional docs by giving reference, i.e. after ur number.

Hi Raman,

As I said, I cant figure out. Maybe they are categorising or queuing on some other basis. I am assuming that my case has been allocated since I have received an email from a specific individual, rather than from their general email id.

I guess I will know for sure only in another 2-3 days.

MY REFERENCE IS 2028xx and it still is NOT assigned to a case worker as at Thursday.

I am unsure how other applicants have already been to a case work and their ref number is like 2035xx.

Thats life. I am sure they are working extraordinarily hard to process these applicants.

My friend told me 75% of applications fail. Amazing stats...

He had claimed total 95 points. He might only have got 10 points in salary (claimed; 35 points) due to not have ITR, but still he qualifies.

Bad news!!! I have been refused on a basis which is an absolute non sense. They are literally crazy. I can't believe they can refuse my application on such a baseless ground. I am an ACCA, a Certified Internal Auditor (CIA) which is a US based global qualification and a Certified Information System Auditor (CISA). I provided letter of equivalence of my CIA qualification by the Institute of Internal Auditors UK as equivalent to UK post graduate diploma and ACCA equivalent to UK masters degree. For ACCA, I didn't need to send them this equivalence letter as it is a british qualification itself. I did my ACCA in UK and worked there on work permit for three years. I am refused because the equivalency certificate against the ACCA qualification was bearing a scanned signature on it rather than original. My question is, first of all I didn't need to prove equivalency against ACCA being a british qualification, secondly an original certificate against my CIA qualification proving it to be equivalent to Post Graduate Diploma was also attached so why didn't they consider that evidence????

Pam,

I did not provide a SARAL form but only provided my form 16, signed and stamped by my employer. I did not tick the box for tax returns and instead mentioned that the tax year in India runs from April to Mar and the available Form16 does not cover my earning period entirely. I therefore, sent bank statements and employer certificates as exceptional evidences.

To be honest, I am not sure the logic that HO used but whatever they did worked for me. I hope your review is sucessful man! Good luck

Paramjit,

Looks like HO is doing lot of subjective approval/rejection based on the individual case worker's interpretation of C.W. Manual (which is not made public yet).

They refuse somebody who do not provide SARAL, saying that ITR not provided, and they approve somebody who does not provide SARAL (I remeber, they said u should have something for IT-dept, right?).

Yeah thats why i m surprised...I do provided form 16...But there is one difference, he said i m not providing ITR and ticked on alternate evdences,,,

I took form 16 as ITR and ticked ITR option. That might be the reason they rejected my earning...

But even without ITR my case worker could had provided me the points...As I i provided Emp letter + bank statements...It is great ignorance from the caseworker side...

Well i prepared my review app in very big detail..I pointed out that I have provided atleast 2 required evidences all companies...Then I wrote in listed view there names per company...Also mentioned additonal evidences in other list under same company...For masters degree i got no new point for them, I just requested if NARIC can award me MAsters status on Provisional pass cert, then HSMP shud also..Just for few words difference one shud not be refused points...

Guys,

What I mentioned for exceptional consideration in the earnings section is as follows,

The tax year in India begins in March and ends in April, therefore, the Income Tax return (Original Form 16, attached on page 17 of evidences folder) only covers earnings between Dec-05 and April-06. Since, the entire 12 month period cannot be covered through the available tax return, alternative evidence in the form of Bank statements and Income staement letters from previous and current employer is attached.

I did not tick on the Income Tax return box because Unless one submits the ITR just after the Tax year ends, ITR will never cover the income period completely. Now considering that Case workers follow a strict rule-based procedure, I have a feeling they reject any case that lies outside their acceptable rules; Even if this means ticking or not ticking a box.

How cum they recognised FORM 16 as ITR. they told me they dont entertain FORM 16 . Otherwise i cud had got the approval.
