tier 1 to tier 2 dependant

Dear All,
I am in tier 1 psw visa,my wife as tier 2 general and my son as her dependant. We are living together and i am in a permanent job. We are maintaing funds. My wife and son are about to apply for their extension. is it possiblefor me to apply along with them as tier 2 dependant or can i apply from UK once they get their extension. Kindly advice,few solicitors i spoked are saying that i can apply.please reply.

Thank You very much Sushdmehta. Also can you please tell me this.In my son's application for PBS dependant, there is a question "is your main applicant is your sole surving parent?'. This question appears tricky for us.Kindly guide.

Dear Greenie,
Both parents are here. My son is applying for tier 2 dependant extension along with main applicant-my wife(tier 2). I am in Tier 1 psw expiring on Jan 2013.

Thank You Greenie, if we put NO to that question,since my leave to remain is very short(jan2013),will it affect my son's visa.

Since i can not switch inside UK,i have to apply as my wife's dependant later outside UK.

Well you clearly have to answer no because both parents are living. Your son will be granted leave in line with your wife.

What is it about the question that you do not understand? Does your wife have sole responsibility for the upbringing of your child? One would assume not given that you are married and the child presumably lives with both of you and thus you are both responsible for his upbringing.

Currently i am holding tier1 psw visa and I'm going to apply as tier2 dep from India. My wife is the main applicant(T2 general) and my son is with us in tier 2 dependent visa and she is here in UK more than 3yrs.kindly advise the fund needs to be maintained.Thank you.
