Dear friends/john,

i would value your opinion regarding a very pressing matter ...regarding elderly parents in India (dad-74 yrs & mother 63 yrs) to bring as my dependants in UK.

I have ILR in Uk.

I have 3 brothers.. one in london on HSMP as well as other 2 brothers working in USA. ( ie...all of my dads children are abroad )

My elderly parents do not have any relatives helping him financially in India other than us, mainly me.

Both me and my brother in UK would like to bring them to UK as dependant and look after them.

We both have houses here and earn sufficent & we can easily accomodate them and look after them.

My parents presently visit UK on visit visa.

I am now finding it extremely difficult to visit india due to work reasons etc and with passing of time find my parents relying more on us.

My parents is visiting us from april 2007 & have visiting visa until june 2007.

How should i go about organising a request to home office ?

Should i wait until i am a citizen?

Can i apply while they visit here in may ?

Should i go through a solicitor and if so who has a good record of dealing with these cases? any Recommendations?

What sort of evidence should i accumulate ?

Any advice by friends on this website especially those who have gone through similar process would be most appreciated.

my parents usually visit us on a visit visa & then go back.
they are planning to visit us again from april until end of visa...ie..june

according to rules their visit visa cannot be switched to dependent visa, but you never know (compassionate circumstance etc )

This cannot be done once they enter UK on a vist visa as the law says visit visa cannot be switched, So you need to apply through the High Commission in your country (INDIA).
Always contact a OSIC approved agent only (http://www.oisc.gov.uk)

When your parents apply for EC as a vistor, they are expected to return to India. They have said to the ECO that they are going to the UK to 'VISIT'. If they then apply in country for anything else, they are guilty of deception and will be refused, especially as there is no reason they cannot return home and apply for it.
