Can I apply Naturalisation while working in Abroad

Post by gunasekaranmohan » Wed Sep 26, 2012 10:06 pm

Hi,

I hope any of you can help me regarding my query on Naturalisation

1. I came to UK on Nov 2006
2. I got ILR on Jan 2012
3. I am working for a same company till now. My employer is planning to move me to Ireland by Dec 2012 for 6 month job (on Green card visa in Ireland).
4. I am away from UK less than 200 days in last five years. I am away from UK for 10 days in this 12 month (2012). If I start my work from Ireland from Dec 1st, then totally, I will be way from country for 70 days in last 12 months.
5. Can I come back to UK and apply Naturalisation on Jan 2013 and return back to Ireland for work? Will this impact my Naturalisation application? Should I be working in UK while applying Naturalisation?

In theory, YES you are qualified to apply. Since you will want to get your passport back, you will have to apply via NCS and you will be required to be in UK 5 days after you submit your application via NCS.

However, you will need to answer the Question 2.3 on the form.

''
2.3 Please tell us in which country you intend to have your main home if you are naturalised.

Also any time spent outside the country due to employment is not a problem as long as you can substantiate that you were working there. A letter from employer stating this would do the trick, so I wouldnt worry about the number of days you are way from UK in the last year (2012)

If the job is for 6 months (or less), you should be fine otherwise you will face an issue with meeting the future intentions requirement (see 2.3 there).

The HO will not grant naturalisation to people not intended to be part of the UK in future.
