FLR M application for Spouse

Post by Antolarain1981 » Wed Sep 26, 2012 3:06 pm

Hi,

I am planning to apply for ILR October 2012 (I completed my 5 years in Aug 2012)

My history

WP Aug 2007 to Aug 2009
Tier 2 ICT extn Aug 2009 to August 2011
Tier 2 ICT extn Aug 2011 to August 2013

My wife joined me in UK on Dec 2011 since she is not eligible for ILR i am planning to make my ILR appln for me first and then apply FLR M for my wife.

My wife is currently in Tier 2 ICT long term staff partner visa which is approved on Dec 2011, the visa will expire on Aug 2013

My question is

1. Should i need to apply FLR M for my wife or she can continue in Tier 2 ICT staff partner visa

2. Somewhere in UKBA site i learnt that if the spouse is already in UK she can change to FLR M from current visa before end of her visa period. is this right

http://www.ukba.homeoffice.gov.uk/visas ... ing-in-uk/

Can anyone please help.

She may enter UK as a PBS dependant on her current visa and extend her leave as a PBS dependant (in August 2013). No need to switch to FLR(M).
