partner visa; EEA and non EEA coupple

I applied partner visa with my EEA nationality boyfriend in the end of May.

I called 2 or 3 timse a month,the answer is always [under consideration]
and [it supposed to be finished in december which is passed 6 months after apply.]

and once they asked more document in october by post.

is it alway taken such as long time???

Immediately prior to making that application, were you legally in the UK? If not that could explain why it is taking so long.

i had proper student visa.

i dont know why it takes such as long time.

Yuka, given that you were legally in the UK, I also don't understand the reason for the delay.

But can you post details how long you have lived with your partner? Also, your partner, in what way do they exercise their EU Treaty Rights? Employed? A student? Or how?

We applied in May 2006 and still waiting HO answer!!! We are in the same situation. The only difference is my partner overstayed. We apply for EEA3/EEA4 even with the overstay history they still should answer within 6 months apparently.

I've lived here more than 4 and half year and my Norigion partner who works here 5 years so far.

we are living 2 and half years now.

in october when they asked more document, its about his finance.
he had to show more letter from work place.

i phoned HO today but it seemed they r busy, the answering machine
hang up.

i didnt know overstayed parson also can apply partner visa as well.

Yula, especially because of the fact that the 6 month time limit enshrined in EU legislation has been exceeded, I would suggest that you make contact with the MP for the area in which you live and ask him/her to contact the Home Office on your behalf, and suggesting to the MP that specific reference is made to the 6 month time limit being exceeded.

Yula, what application form(s) were submitted? An EEA1 by you .... and also an EEA4 by your partner?

thanks, i just talked with HO over the phone now.
they said just under consideration, couldnt get any further information.

i didnt know the MP of my area can deal with it.
could u tell me more about it?

i applied with EEA2 form, which is HO advised.

Of course it is the EEA2 form for you. Apologies!

The MP for the area in which you live? Go to http://www.writetothem.com/ and then enter your postcode ... and all will be revealed! You should find a hyperlink to your MP.

Thank you for the advice. on that day, when i called HO, the stuff there adviced me to write a letter to ask further informationa as well.

I already wrote and sent one.
If they dont give me any response, I'm gonna ask the MP as well.

I am still waiting too. Application sent in May.
Next week if nothing has arrived I will contact Solvit asking them to take our case.

why does it take so long
its a simple form

HSMP gets done in weeks
is this becuase they charge for it?


there should be penalties if the application is not see to in 6 months
long time to be without your visa!


if they cant see to it in 6 months then they should just issue it!

HSMP is totally different in a sence.
but i just heard HSMP is getting to take long time as well as difficult.
(of course not like my situation though)

I just got my passport back today!!!!!

I applied for partner visa, but I got family permit which is for 5 years!

I can work full-time, and I can travell!!!

Yuka, congratulations.

You applied on form EEA2, on the basis of being an extended family member, as defined on the EU regulations that came into force on 30.04.06.

So the 5-year Residence Card you have got is totally logical.

My solicitor has written another letter to HO. Hope we will get result. if not i will ask solvit.
It has been nearly 9 months now! What else can we do?

It may be best to contact Solvit now. It gets them started on the problem, and ensures the EU is aware that there delays in processing EU/EE family applications in the UK. The 6 month time limit is not optional for the home office!

i believe the application take so long because my partner has overstayed even if we have lived togther 5 years and we got french civil partnership registered in 2001. I have treaty right and been in the uk since 1996.
