Tier 1 dependant --> Tier 2 (general) main applicant RLMT

Post by simple.but.honest » Mon Oct 01, 2012 1:33 pm

Hi,

Just a quick question, If Tier 1 (PSW) dependant with UK Masters degree which is recently completed wants to switch into Tier 2 (General) as a main applicant, would the company still need to do the Resident Labour Market Test or it is exempted. Also considering employee working with the same company for more than 2 years.

Reference Page No. 21-22-23 http://www.ukba.homeoffice.gov.uk/sitec ... idance.pdf

says about the UK degrees and exemptions of RLMT but not sure does it cover this situation as an exemption?

All Gurus are requested to help which is highly appreciated!

Cheers!

1. A dependant cannot "switch".
2. A "dependant" of Tier 1 (PSW) is not a Tier 1 (PSW) migrant, so no exemption.
Life isn't fair, but you can be!
