£18,600??

My situation is as follows:

My contract states £15,000
However, I consistently work an additional day so on calculation my yearly gross income taken from the last 6 months equate to more than £18,600
My employer is unwilling to change my contract nor is he unwilling to write a letter explaining the "guaranteed" extra day I do per week.
income is reflected in my bank statements.
My last years P60 does not reflect £18,600 rather it reflects £15,000, the increase in day started in April 2012.

will an application for a spouse visa under the maintenance rules be too risky? or will my bank statements and 6 months wage slips suffice the min requirements

I understand that your annual salary with be based upon the lowest paid month from your last 6 months payslips. So if the lowest paid payslip in your 6 months bundle adds upt for the £18,600 annual gross salary, you should be fine.

I let others to give further confirmations.
Feb 2012 - Spouse Visa - New Delhi
Mar 2012 - Documents collected - VISA Granted
March 2014 - ILR Granted
Apr 2015 - Applied for Naturalisation

From the IDi:

5.3.1 Category A: salaried employment for the last 6 months
Where the applicant’s partner and/or the applicant (if they are in the UK with permission to
work) is in salaried employment at the point of application and has been with the same employer for at least the last 6 months, the applicant can count the gross annual salary (at its lowest level in those 6 months) towards the financial requirement.

Would that then mean the gross annual salary of £15,000 rather than the additional overtime, i presume that represents the lowest level?

any thoughts anyone??

gross annual salary, at its lowest level in those 6 months
An annual salary of £18,600 means a gross monthly salary of £1,550.

So if any of your payslips in the last 6 months have less then £1,550 as Gross Pay for the month. ECO will use that as a basis to calculate the annual salary.

So if all your payslips in the last 6 months show £1,550 or above as the Gross pay you should be fine. Otherwise the shortfall needs to be covered by savings.
