Hi,

I am on Tier 1 General Visa and got my first extension in Dec 2011.

Visa Date : 6th January 2009
Valid till : 6th January 2012
Arrived in UK : 6th March 2009 (After 58 Days after visa starts)

First Extension : 8th December 2011 (31 days before visa ends)
Valid till : 7th December 2013


Apart from the above 84 days (53 + 31) I had been to India each year around 50 days all in total last 4 years.

Now I have read somewhere that for ILR we should be in UK for 5 years and should not be outside for more than 90 days.

My question is does it mean I need to apply for one more extension to cover my gap and holiday trips.

Hi, as per current rules while let the caseworkers apply discretion, if you entered UK upto 90 days AFTER your visa stamping date, you can count the period between your entry and visa stamping date towards the 5 years.

So in your case, you can apply 28 days before 6th January 2009. If you have leave expiring before that date, then you will have to apply for extension. This is my understanding at least.

Other qualifying categories (which includes T1 G)
Applicants in other qualifying categories can qualify for indefinite leave to remain after five years.
Applications that fall short of the five year continuous periodIn some cases, applicants may have been granted five years continuous leave, but due to delayed travel will not have spent five years continuously in the UK before their current leave expires. Caseworkers may count the period between entry clearance being granted and the date the applicant entered the UK towards the five years, provided this period was not longer than three months.

OK people, based on what said above...

first thing, so far i had been to India on annual leaves and others for total of 98 days and the limit is 180 days so I am fine in that...

I am little confuse about whether on 7th December 2013 when my visa is expiring, should i apply Extension or ILR ???

Just to be clear,

My Visa Starts 6th Jan 2009
Came to UK 6th Mar 2009 (59 Days later)
2nd extension Expires 7th Dec 2013 (30 Days before)

Could you please reply what should I be doing at the end of my visa expiry, apply for extension or ILR???
