Possible to request a post-dated FLR (in country switch)?

Post by kawasaki1 » Sat Jan 20, 2007 8:43 pm

I was wondering....

If one is here on a WP that is valid for a few more years but is switching to HSMP, can they ask for their HSMP FLR to be postdated by a month or so?

This would be useful in a case when someone's 5 years for ILR expires in say March '09. In order to change employer they successfully got the HSMP approval letter and should start working for new employer 1st March. Now, if one is to send the FLR application early Feb, it could be stamped with a Feb date which might cause problems for later ILR application. Post-dating to 1st March would be ideal - no ILR issues later and the work gets switched on the same date that it is legally allowed. Did that make any sense?

Thanks

Fair enough, I seem to remember a while back someone posted about postdating EC with the old HSMP scheme when they have valid reasons so was wandering if the same could apply to FLR (couldn't dig out the thread unfortunately).

Ok, then another question. Say one has completed 4years and 10months on a combination of WP and HSMP and their visa is expiring, would the HO be willing to let them apply for ILR at that point under special consideration or would you need another extension to cover the extra 2 months?

Thanks in advance.
