Appeal withdrawn. Who bears the cost?

My Tier4 application was refused due to maintenance fund was less than 28 days. The fund was actually correct and enough for 28 days but the UKBA has made a mistake in their calculation. In the refusal letter, it was said that I cannot produce new evidence nor to appeal for the Tier4, but I can appeal under HRA. I then made the appeal to the Tribunal under HRA. However, the UKBA representative noticed this error a few hours before the hearing, and he withdraw from the appeal before the hearing and submitted to reconsider the original decision. I paid for the Tribunal fee as well as my solicitor's fee. Now, can anyone tell me if I can claim this from the UKBA as it was not my mistake in the first place. Thank you.
