Hi All

ILR Earnings less than Extension or 1st Tier, but above minimum threshold.

My query sounds similar to post, http://www.immigrationboards.com/viewtopic.php?t=117439

but my question is slightly on different note hence posted as a separate thread.

I am planning for future ILR and hence with my tier 1 ext appearance yet to happen in few days. I can change my claim of earning points in extension while I have time in hand, based on outcome of the responses from all Experts in this forum.

Scenario 1:
If ILR Earnings less than Extension, but points wise equal to 1st Tier 1 application, would there be a problem in ILR eligibility?


Example:
Point System: As on 2010 Dec - (80 pts is the minimum requirement)
1st Tier 1 : Pts Scored 85
Tier 1 Ext : Pts can claim 95
ILR : Pts Scored 85 (Assuming: Due to less Earning)

Scenario 2:
If ILR Earnings less than Extension, but points wise equal to 1st Tier 1 application, would there be a problem in ILR eligibility?

Tier 1 Oct 2012 Guidance form says:
"84. An applicant may claim for a period of earnings of less than 12 months if they have earned sufficient funds to claim the necessary
points."

Any suggestion would of great help.
