Immigration of Kid after divorce

Post by AndyGandhi » Mon Nov 05, 2012 6:31 pm

Hi Seniors,

I lived in UK with my family. Unfortunately, me & my wife are divorcing. I got ILR, but wife & kid(9yrs) are staying in India. Wife & kid stayed in UK as my dependents. Due to divorce, dependant visa of wife has been revoked & kid has been treated as dependant on wife, so her visa is also cancelled.
If during divorce, it is decided that Kid will stay with me, can I bring my kid to UK, as my dependant, on ILR. Child was born in India.

I appreciate the suggestions.

Andy

Yes, if you get sole responsibility of the child.

Thanks Sush for your reply.
India is not in the list of countries, whose orders are recognised by UK.
Could you please sugggest, what to do in that case?

Decree absolute and a court order granting you sole responsibility / sole custody of the child from a court in India will be sufficient.
