Visa Waiver and AOS question

Hello,

Could anyone advice if it is possible to apply for adjustment of status for a spouse visiting on the visa waiver, if the marriege took place in the US during his/her prior visit? Thank you for any information you can share.

Yes it is possible. A consult with a competent immigration attorney however could be in order so they are able to advise based on your entire circumstances.

Many successfully adjust status in the US when granted entry to the US and are otherwise eligible. However if there was immigrant intent on entry and this is uncovered during this process, then your wife could be denied and face a lengthy ban. Some resources for you to read
