Switching from Tier 2(General)

Post by Tier 2 General » Fri Nov 02, 2012 1:24 pm

I am an Indian national and did MSc. from UK.Currently I am on Tier 2 (General) visa. This visa is sponsored by my current
employer. Unfortunately my current position has been made redundant so I am actively looking for work.
Ideally the potential employer need to provide me just over two years of sponsorship so that in April 2015 I will become eligible to apply for an indefinite leave to remain in UK.

As it is hard to find a sponsor within 60 days from now so I am looking for other options as well.Is there any other immigration category in which I can apply and work for any employer?

The only viable option (other than to continue in T2) is Tier 1 (Ent) but that would require a capital investment of 200K and you would be limited to working in your own business. Additionally, the time you have already accrued on T2 will not be considered for a settlement application, unless it were aggregated into a period of 10 years.

This question may not be related to the original topic.

But why wouldn't the time accrued on T2 in above case be considered for a settlement application?

Because the immigration rules dictate so!

Thank you for the reply.

Paragraph 245HF in Immigration Rules (Part 6A) doesn't say anything like that. May be I am looking in the wrong place. Could you please direct me to the right place? Thank you.

If you have Ter 1 (Ent) leave you apply for ILR as a Tier 1 (Ent) migrant ,rather than a Tier 2 migrant. Refer yourself to the conditions for IRL for a Tier 1 (Ent) migrant rather than a Tier 2 migrant.
