ILR OR FLR(M) For my Wife

Hi All,

Jan 2012, I applied ILR on long residency basis.
June 2012, they refused me and took them for Judicial review.
28 August, me and my wife applied for tier 2 general extention,
05 Nov 2012, Ukba sent my passport with ILR because they did not want me to for Judicial Review!
14 Nov 2012, they sent my wife's passport with no visa, advising she should apply for the right category as husband got the ILR.

My wife came in May 2010 and now she has stayed in uk over 2 year....

Please advice, should we go for FLR(M) or apply for her indefinite???

Please help....Solicitors are contradicting themselves.....

What is your wife's current immigration status?

My wife status is tier2 general dependent. She has no visa at the moment. As we sent passports for extension of tier2 general visa before expiry date of 31st August. HO sent my passport back with ILR rather than tier2 extension as they didn't want me to go for judicial review.

They sent passport of my wife with no visa with a covering letter saying as they have given ILR to your husband, so you should apply again with right catagory and we will give you full refund for this application.

As my wife been here since may 2010 which is over 2 years, what should we apply flrm or set m?

We received passport on 15th November this month.

I will appreciate your help. I can see you are quite active senior of this forum.

I want to apply for settlement, we have been married almost 5 years, have two kids born here, wife has live almost 31 months in uk with me.

Someone else please advise, is ILR possible for my wife??

I need your expertise....

Hi All,

I called ukba and explained the situation today. Ukba staff advise me to fill SET O, and told that they have been advised by their senior, pbs dependent do not have to apply Flrm if they have fulfilled qualifying period which they were advising before.

So I am going for SET O. I hope all is going to be well.....

Hello Jilmilco, there have been a couple of similar cases that the spouse of long residence applicant applied for ILR directly by using SET(O) form (http://www.immigrationboards.com/viewto ... c&start=20). So your wife has a good chance of getting her ILR as well. I would suggest you to go to a PEO office so that you can clarify with them first before they take your application fee. Let us know your result.

What is SET M application. My solicitor is asking me to do SET M??

I don't think your wife can use SET(M), if she hasn't got FLR(M) first, check the form for more information. If you go to a PEO office to try SET(O), you don't really need a solicitor.

Try Solihull as first choice, then Sheffield. Croydon should be your last choice.

Hi Jilmilco, please check your message box for my reply. Also please remember that when your wife goes to a PEO office, check with the staff first that she could use SET(O) and also mention that you were advised by HO to use this form. Then even if they don't allow your wife to apply for ILR directly, it is unlikely that you will lose your application fee as you have checked with them first.

Home office sent my wife's passport back on 14th November. How many days does she have to apply for it, as her visa has already been finished on 31 august and she has no visa at the moment?

The Letter was dated 12th but received on 14th.

Hi Mehta,

Today my wife pass life in uk. I am taking her for PEO solihull on 5th December. I am going to try SET O first, if not then FLRm.

I have a question regarding FLRm is that as my wife came to uk before 9th July, so rules applies on her before 9th. Do we have to fill the financial sections???

I was reading guidance notes and it says

" if you were granted leave to enter or remain as a partner following an application made before the 9th July 2012 you are not
required to complete section 7A, Proceed to 7B MAINTENANCE."

are we exempt from this section???

Hi Guys,

We have been to solihull PEO. They kept us waiting for 2 hours for SET O and said finally SET O will not be possible. So, We had to change the application form to FLRM. Now we are going back on 20th December for ILR, my wife is eligible for it now.
