hi all... do write a letter to your case worker and this was advised by call center. i did the same and after 3 days i got good news.shadisami9 wrote:Hi folks,
Just a quick question.i can see that there is a great number of people on this forum who are negatively affected by the delay and hugely dissapointed by the service standards of the UKBA.we are moaning on this forum and sharing our negative experience which reminds me of the addicts anonymous groups which doesn't come up with any practical solution to the problem.
Has anyone thought of utilising this wasted energy in lobbying to bringing this to the media and/or human right organisations?

thank you.. very good rule,, need to wait until 13.12jkdlondon wrote:http://www.ukba.homeoffice.gov.uk/sitec ... r/35-rules
Other changes in immigration rules will allow skilled Indian and other non-EU workers the flexibility to travel in and out of the country, without it counting against them when it comes to applying for settlement in Britain, sources said.
From December, migrants could be absent from Britain for up 180 days annually without it affecting their application to stay permanently in Britain, provided it is required for a legitimate reason.
it is true coolbawa...his ILR was refused and his last posts on this forum was deleted by sushdmehta for unknown reason and mine as well regarding his case.He started the new tread herecoolbawa wrote:

that is not a good sign for all of us with >90?
one hope just wait until 13.12 when the new rules coming in to the force..
exactly!!! from August 2007 to November 2012 you have more than 5 years of continuous residency..and they considering continuity in 5 years from the date of application or from the date of decision in reverse.coolbawa wrote:I dont have any >90 or 180 in total... lets see if they do justice in my case. I assume they consider 12 calendar months from when someone enters in this country and not just JAN-DEC.
ramay why you saying it will not work for you ??? if your case is decide after dec 13 it will apply to you . plz correct me if i'm wrong.ramay wrote:page 4

In respect of the other changes set out in this Statement, if an applicant has made an application for entry clearance or leave before 13 December 2012 and the application has not been decided before that date, it will be decided in accordance with the Rules in force on 12 December 2012."
unfortunately..looks like it will not work for us..

Thank you sushdmehta for your encouragement ..I like what you said..sushdmehta wrote:ryan2020 is correct in his interpretation, if an application has not been decided by 13-Dec-12 then the new changes with regards to absences will apply to the undecided applications.
Perhaps UKBA has been sitting over some of such applications on purpose? Who knows? Whatever the reason, it is good news for all those who have excess absences (under old policy) and are still waiting.
Cheer up! Such delays that result in a bonanza are very very rare as far as UKBA is concerned!!! Time to thank UKBA for the delays!! And pray that the caseworker assigned to your respective applications sleeps over them for a few more weeks!!

In my case I entered in April 2007 and after 2 weeks went to home country for 129 days and came back in August 2007.
thanks ramay, i didn';t apply for extension as you dont have right of appeal if they refuse your extension after getting refusal from ILR.ramay wrote:see ryan new rules are comming in to force from 13 of December maybe you can get some benefit from it for example: make application for an extension in 28 days from refusal(after 3C) and then vary to ILR after 13.12 if not decided by that time or make a fresh ILR application..
strange..sushdmehta wrote:The document clearly specifies when and how the changes specified in specific paragraphs of the document will be implemented. You need to first check the paragraph(s) which specifies the rule(s) you may be interested in, and then see when and how the change will be implemented.
The text you have quoted from the document does not apply to the paragraphs which prescribe the changes related to absences.
Yes, the pattern in which we took more than 90 days is similar but am banking on the fact that I have already covered that much lost period while waiting for my decision. If I am considered short of 129 days initially then I have spent more than that while waiting in last given 5 years. So hopes are still there....ramay wrote:coolbawacoolbawa wrote: Sorry to hear about Ryan case but anyway each case is different...

Hi, Did you include any document from your home country with your application?annoyed wrote:Not annoyed any more .
Got an update from UKBA that a check was being done on documents that need to be verified in my home country [and I think it is beyond the control of UKBA]. So just waiting for that check being completed ASAP.
