Need advice for eligibility for ILR

Hello,

I entered the UK in Dec 2007 on a work permit and later in 2008 changed the visa category to Tier 1(General). I have completed 5 years in the UK (1 year on work permit and 4 years on tier 1 (G)). I know I am eligible for applying for ILR now.

For my wife to be eligible for ILR, she has to complete 2 years in the UK. My wife arrived in the UK on 29th December 2010 so she completes the requisite 2 years on 29th of this month. That means both of us will be fully eligible to apply for the ILR after 29th Dec 2012.

But then UKBA site says that a person can apply for visa/extension within 28 days of eligibility.

Does that mean that I along with my wife can apply for the ILR anytime after 2nd December 2012... even though my wife hasn't completed 2 years... but obviously with in 28 days of her eligibility.

You wife cannot apply before 28 days as she needs to complete 24 months before she applies for ILR

The confusion was aggravated by the fact that when I called up home office earlier to clarify, they said my wife is eligible even though she hasn't completed 2 years but with in the 28 days of eligibility. But this morning when I called them up again... they said exactly what you have written.
